Stolen bike lands Barrhead man with two 30-day sentences

BARRHEAD - A Barrhead man received two 30-day sentences concerning a bicycle theft in early September.

Rodney Wendell Prince received two 30-day sentences to be served concurrently after pleading guilty to possession of stolen property and failing to comply with conditions of an undertaking at Barrhead Court of Justice on Nov. 15. 

Due to the time Prince has served in custody, he was credited with time served.

Justice Jeffery B. Champion handed down the sentence, accepting a joint submission from the federal Crown and defence lawyer Gordon Collins.

The facts

On Sept. 7, an individual reported that his mountain bike had been stolen from outside a 49th Street business, providing police with a picture of the bike and its serial number.

About two weeks later, on Sept. 22, the Crown noted the victim's spouse spotted the bike at a storage unit on 61A Avenue. She then took a photo of the bike and showed it to the RCMP.

Prince and another individual listed on the docket as the co-accused can clearly be seen in the photo.

The Crown also stated that a witness said they saw Prince and the other individual put the bike into the storage locker and then lock it.

"At the time of the offence, Mr. Prince was bound by an undertaking, was not to have contact with [the other person in the photograph]," he said.

Prince, who attended the proceedings via CCTV from the Edmonton Remand Centre, agreed with those facts.

The Crown then entered Prince's criminal record into the record.

The prosecutor did not indicate the nature of the offences, but Justice Champion told defence lawyer Collins that "there was a certain consistency to the record".

Collins agreed, stating that Mr. Prince and the other individual in the photo, the co-accused, suffer from drug addiction issues, which they are both attempting to overcome.

Champion accepted the joint submission, saying he was "satisfied that was a fit and proper sentence".
