Man dwelling unlawfully in Colinton sentenced to five months custody

A man was sentenced to 149 days in custody June 18 after pleading guilty to four charges, including unlawfully dwelling in a home and possession of stolen property over $5,000.

A man was sentenced to 149 days in custody June 18 after pleading guilty to four charges, including unlawfully dwelling in a home and possession of stolen property over $5,000.

Jason Oltmanns, who appeared in Athabasca Provincial Court in person while in custody, also pleaded guilty to failure to comply with conditions of recognizance and possession of a controlled substance. Oltmanns was given enhanced credit for 100 days of pre-trial custody, satisfying his sentence.

In a statement of facts, Crown prosecutor Euan Gilmour said police patrolling Colinton Feb. 4 saw an F150 truck backing into a residence it did not belong to.

“The accused was coming out of the residence. He was in the residence,” Gilmour said. “He did not have permission.”

The F150 had previously been stolen, Gilmour said. He added police discovered a small amount of methamphetamine in a search incidental to Oltmanns’s arrest.

For the charge of breaching of conditions of recognizance, Gilmour said Oltmanns was released and told not to have any contact with a named individual, but was found together with that individual Feb. 23.

Judge Clifton Purvis agreed with a joint submission in the sentencing, which included 149 days served concurrently for each of the Feb. 4 charges, as well as a sentence of 30 days served concurrently for the charge of breaching recognizance.

Oltmanns was also given a $200 victim fine surcharge for each count from Feb. 4 and a $100 victim fine surcharge for breaching recognizance. The surcharges were satisfied by his attendance before court June 18, Purvis said.

Man admits to punching person's face, driving away 

A man pleading guilty to assault and theft of a motor vehicle was sentenced to four months in custody during Athabasca Provincial Court June 18.

Shaun Bradley Cardinal, 34, appeared in court in person and was given enhanced credit for two months served in pre-trial custody. Cardinal will serve one more month in custody as of June 18.

Gilmour said in a statement of facts Cardinal was at a residence in Calling Lake April 18, where he got into a fight and punched a person in the face. He then stole another person’s keys and drove away from the scene in a vehicle that did not belong to him.

Defence lawyer Bruce Lennon said there were other factors to consider in his client’s sentencing.

“I would note the injuries were relatively minor,” Lennon said during court, referring to the victim's injuries. He added the guilty plea is also mitigatin. “Not an early guilty plea, but a guilty plea.”

Purvis agreed with a joint submission in sentencing Cardinal to four months in custody. A $100 victim fine surcharge was satisfied by his appearance in court June 18, Purvis said.
